the parties consent to personal and exclusive jurisdiction in these courts and waive any objection to such jurisdiction and venue. Notwithstanding the foregoing, other than claims that must be resolved through binding arbitration (or that may be brought in small claims court), OnePlus reserves the right to institute proceedings and/or apply for injunctive remedies (or any equivalent type of urgent legal relief) against the user in the courts having jurisdiction in the place where the user has its seat or in any jurisdiction where harm to OnePlus is occurring. </p> <p>17.2 These Terms of Use will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. </p> <p>17.3 ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.
