It seems a little ridiculous that imposing a ratelimit at all is something that counts negatively. This isn't a term allowing the service to arbitrarily deny service to people, but instead just to prevent people from spamming. This term is also strange to include negatively since literally any private business has the right choose who to do business with - this term is implied legally for every company, whether or not they state it.
