DISNEY+ SHALL BE FULLY LIABLE IN ACCORDANCE WITH STATUTORY LAW FOR (A) DAMAGES CAUSED BY WILLFUL MISCONDUCT OR GROSS NEGLIGENCE, AND (B) DAMAGES TO LIFE, BODY OR HEALTH CAUSED BY WILLFUL MISCONDUCT, GROSS NEGLIGENCE OR OTHER FORMS OF NEGLIGENCE.<br> <br>IN CASE DISNEY+ PROVIDES A PHYSICAL PRODUCT OR ELECTRICITY, DISNEY+ SHALL FURTHER BE FULLY LIABLE IN ACCORDANCE WITH THE GERMAN PRODUCT LIABILITY ACT (PRODUKTHAFTUNGSGESETZ) OR OTHER LAWS TRANSPOSING COUNCIL DIRECTIVE 85/374/EEC.<br> <br>DISNEY+ SHALL FURTHER BE LIABLE IN ACCORDANCE WITH STATUTORY LAW FOR DAMAGES CAUSED BY SIMPLE NEGLIGENCE RESULTING IN A BREACH OF ANY CONTRACTUAL OBLIGATION THAT IS A PREREQUISITE FOR THE PROPER PERFORMANCE OF THIS AGREEMENT AND ON THE PROPER PERFORMANCE OF WHICH YOU COULD THEREFORE REASONABLY RELY (SO-CALLED ESSENTIAL OBLIGATION).<br> <br>IN ALL OTHER CASES, THE LIABILITY OF DISNEY+ SHALL BE EXCLUDED.<br> <br>
