This one part makes the entire ToS as a contract on shaky legal ground at best. At worst, based on precedent, it would possibly render the entire thing illusory and unenforceable should they actually try and enforce it and not just use it to ban people like most websites do. I'm not a lawyer, this is just my interpretation of court cases and should not be taken for legal advice.
