They can change the terms of service any time they see fit, even without notification to the user. Your use of the service supposedly constitutes acceptance of the changes in the terms.

Both the case and the analysis claim that the service does not notify users of changes to its terms. The quote, however, indicates that in the event of "material" changes, the user is indeed notified. Please reconcile these differences.
