The Parties agree that the liability for direct damages, damages arising out or related to this Agreement may not exceed the amount paid by the COSTUMER in the last 12 months prior to the harmful event, except in cases of serious neglect or intentional misconduct.</p> <p>11.2.1&nbsp. The above limitations will apply whether an action is in Contract or tort and regardless of the theory of liability.&nbsp.
