UNDER THESE ACTS ARE GUARANTEES WHICH INCLUDE THAT GOODS AND SERVICES ARE OF ACCEPTABLE QUALITY. IF THESE GUARANTEES ARE NOT MET, THERE ARE ENTITLEMENTS TO HAVE THE SOFTWARE REMEDIED (WHICH MAY INCLUDE REPAIR, REPLACEMENT, OR REFUND). IF A REMEDY CANNOT BE PROVIDED OR THE FAILURE IS OF A SUBSTANTIAL CHARACTER, THE ACTS PROVIDE FOR A REFUND.</p> <p>If you live within the European Economic Area, Switzerland, or United Kingdom, this Section does not apply to you. Please see the <a href="#globaladdendum">Global Addendum</a> for the limitations of liability that apply to you.</p> <h2 id="19nbspnbspnbspnbspnbspnbspnbspindemnification"><strong>19.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; INDEMNIFICATION</strong></h2> <p>To the fullest extent permitted by applicable law, you will indemnify and hold harmless, and at Big Fish’s request defend, Big Fish and the Big Fish Parties from and against any and all losses, liabilities, claims demands, costs and expenses (“<strong>Claims</strong>”) arising out of or related to (a) your access to or use of the Big Fish Offerings; (b) your User Content or Feedback; (c) your violation of these Terms of Use; (d) your violation, misappropriation, or infringement of any rights of another (including intellectual property rights or privacy rights); or (e) your conduct in connection with the Big Fish Offerings.
