The failure of Discogs to exercise and enforce any right or provision of the TOS shall not constitute a waiver of such right or provision.
Even if Discogs does not consistently enforce all of the rules or provisions in its terms, they still apply. Users can at a later time still be held accountable for violating provisions that have not been enforced consistently.
