<p>If we are unable to resolve a dispute through the informal dispute resolution process, any remaining controversy, allegation, dispute, or claim between You and Ubisoft, whether based in contract, statute, regulation, ordinance, tort (including, but not limited to, fraud and any other intentional tort or negligence), common law, constitutional provision, respondeat superior, agency, or any other legal or equitable theory, whether arising before or after the effective date of these terms, shall be resolved through final and binding arbitration. This includes, but is not limited to, those arising out of or related to this Terms of Use; the EULA, the Privacy Policy; or our Ubisoft site, products, or licenses; any advertising, marketing, or other communications with or regarding Ubisoft or its site, products, or licenses; any Site Content or User Content; or any other interaction or transaction between You and Ubisoft, whether heretofore or hereafter arising.
