In the event the Dispute is not resolved within thirty (30) days after submission, either party may institute arbitration proceedings in accordance with the procedures set forth in this Section.</li> <li>Agreement to Arbitrate. Except as otherwise expressly set forth in this Agreement, any and all Disputes of every kind, arising out of or related to this Agreement (whether contractual or non-contractual) shall be subject to final, binding and confidential arbitration conducted by the American Bar Association under its rules of arbitration in force as of the date such Dispute is referred for arbitration (the “Rules”).
