You agree that if any dispute arises hereunder, either you or Nokē shall demand in writing that the Dispute be arbitrated, in which case you and Nokē agree that each party will immediately stay any court proceedings and the plaintiff will submit the Dispute to binding arbitration by a single arbitrator under the “Supplementary Procedures for Consumer-Related Disputes” of the American Arbitration Association then in effect, in Salt Lake City, Utah. If for any reason the AAA cannot hear the dispute, you agree to proceed before any mutually-agreed arbitrator or, if unable to agree, before an arbitrator appointed by the AAA in accordance with its rules, as applicable.
