All controversies, disputes or claims arising out of or relating to these Terms of Use will be determined pursuant to the mediation and arbitration procedures of JAMS, and administered by JAMS or its successor (<strong>"JAMS"</strong>) in accordance with the comprehensive rules and procedures, including the optional appeal procedure, of JAMS (<strong>"JAMS Rules"</strong>), as modified by these Terms of Use. The parties will endeavor first to attempt to resolve the controversy or claim through mediation administered by JAMS before commencing any arbitration.
