Except as set forth elsewhere in these Terms to the contrary, any dispute, controversy or claim relating to these Terms or the Application shall be resolved through a confidential, final, binding, and non-appealable arbitration under the rules of the American Arbitration Association (the “AAA”) in effect from time to time (with right to engage in pre-hearing discovery in connection with such arbitration proceedings if approved by the arbitrator).
