If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision will be limited or eliminated from this Agreement to the minimum extent necessary and will not affect the validity and enforceability of any remaining provisions.</p> <p> <b>16.9 Survival.</b> Upon termination or expiration of this Agreement for any reason, the following provisions will survive such termination or expiration: Sections 4, 5.3, and 10 through 18.</p> <p> <b>16.10 Third Party Beneficiaries.</b> There are no third party beneficiaries to this Agreement.</p> <p> <b>16.11 Waiver.</b> The failure of Aura to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision.
