Under no circumstances, including negligence, shall either Branded, the Branded Surveys Program, or the Site, be liable for any direct, indirect, incidental, punitive, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Branded has been advised of the possibility of such damages) arising out of or in any way connected with your use of or performance of Branded Program and/or the Site, whether based on contract, tort, negligence or strict liability.
