This excerpt doesn't cover binding arbitration, it's more focused on limiting claims against both parties. The document later specifies that "YOU AND VISIBLE BOTH AGREE TO RESOLVE DISPUTES ONLY BY ARBITRATION OR IN SMALL CLAIMS COURT". So the service doesn't force the user into binding arbitration.
