Court of jurisdiction for all disputes arising from or in context with the agreements between Customer and AV-TEST shall be Magdeburg, in as far as Customer is a merchant as defined in the German Commercial Code, a legal entity under public law or a special fund under public law. In this case AV-TEST shall, however, also be entitled to take legal action before the court having local jurisdiction over Customer.</p> <p> <strong>17.5</strong> .
