not sure how this compares to what other sites do, most other services are not really merchants in the way Amazon is a merchant, so waiving your consumer's rights of implied merchantability may be ok for other services, but maybe not for online shops like Amazon.
they also actually say a few lines down that in some parts of the US this part of the ToS is actually illegal. i'm tagging it as 'Bad' for now, until we have more examples from more "online shop" type of services.
