If the Service or a portion thereof becomes, or in Watermark’s opinion is likely to become, the subject of an infringement claim, Watermark may, at its option and expense, either (a) procure the right to continue using the Subscription Service or portion thereof, or (b) replace or modify the Subscription Service or portion thereof so that it becomes non-infringing.
