B. was generally available to the public or otherwise part of the public domain at the time of its disclosure to the other Party; </p> <p>C. became generally available to the public or otherwise part of the public domain after its disclosure and other than through any act or omission of the receiving Party in breach of this Agreement. or</p> <p>D. was disclosed to the receiving Party, other than under an obligation of confidentiality, by a third party who had no obligation to the other Party not to disclose such information to others.</p> <p>15.4 Each Party may disclose Confidential Information if such disclosure is necessary to comply with applicable governmental regulations, laws or stock exchange rules, provided that the Party required to make any such disclosure will, to the extent practicably possible, give reasonable advance notice to the other Party of such disclosure requirement and will use its best efforts to secure confidential treatment of such information required to be disclosed.</p> <p>15.5 Each Party is entitled to discuss Confidential Information with its accountants or other advisors provided that they are subject to professional obligations of confidentiality similar to those contained herein.</p> <p> </p> 16. MISCELLANEOUS <p>16.1 Acast has the right, fully or partly, to transfer our rights and obligations to third parties under these Terms.
