However, either party may disclose any Confidential Information: (i) to its own personnel and professional advisors to the extent required for the proper performance of its obligations under this Agreement (where the relevant personnel are informed of the confidential nature of the information and are subject to appropriate confidentiality undertakings). (ii) to a 3<sup>rd</sup> party Business Partner engaged by the Customer and as notified to Tes. and (iii) as may be required by law, a court of competent jurisdiction or any governmental or regulatory authority.</p>
