<p> <strong>Additional Information – Privacy Statement for California Residents</strong> </p> <p>We are GOG sp. z o.o., a company incorporated in Poland (we will further call ourselves “GOG”, “we”, “us” or “our”). We have included this California-specific information below to inform you about additional rights regarding our use of your personal information under the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. This Privacy Statement applies only to visitors, users, and others who reside in the State of California (“users,” “you,” or “your”). Below, we explain our privacy practices and your rights regarding the collection, use, and disclosure of your personal information.</p> <p> <strong> <u>Information We Collect</u> </strong> </p> <p>Personal information is information that directly or indirectly identifies a particular user, household, or device. We have collected the following categories of personal information from users within the last twelve (12) months:</p> <p>Personal identifiers: such as, username, name, email address, a password (which is encrypted so that we don’t have access to it);</p> <p>Other identifiers: such as, device identifiers, IP address, or other unique identifiers;</p> <p>Commercial information: such as, your list of games, order details, purchase history, refunds, other purchasing and payment information;</p> <p>Activity information: such as, your operating system, browser type or other technical details provided by your web browser, metrics information about when and how you use GOG services (such as what games you are playing, page views), your wishlist, forum content, advertising data and other information collected via cookies and related tracking technologies</p> <p>Geolocation data: such as, geolocation based on IP address for tax purposes</p> <p>Audio, Visual and Similar Electronic Information: such as, your avatar picture. and</p> <p>Inferences drawn from other personal information: such as, user profile or inferences drawn from purchase or browsing history.</p> <p>Customer service: such as, account restriction history, complaints and issue raised;</p> <p> <strong> <u>Collection of personal information</u> </strong> </p> <p>We obtain personal information from various sources, including but not limited to:</p> <ul> <li>Directly from you f.ex. information you give us when registering a GOG account;</li> <li>Directly and indirectly from your activity on GOG services;</li> <li>From our vendors, affiliates and business partners that help deliver our services and functionalities to you f.ex. we use software and support ticket system to help us managing your customer support requests;</li> <li>Social media, other platforms and other third-party accounts, if you choose to link them.</li> </ul> <p> <strong> <u>Use of personal information</u> </strong> </p> <p>We may use your personal information: (1) to fulfill the reason for which the information is provided. (2) to provide you with information, products or services that you request from us (like providing access to your GOG account). (3) to provide you with information, products or services which we feel may interest you, such as newsletters or emails about GOG services, special and occasional offers, ads and product recommendations on the basis of your purchases or activity (of course, it’s optional). (4) to perform a contract. (5) to ensure that GOG services are presented in the most effective manner for you and for your computer or other device from which you access GOG services. (6) to improve or modify GOG services, f.ex. based on which games you like, how you play them, reported problems, your suggestions or satisfaction surveys. (7) to communicate with you (f.ex. about changes in the GOG User Agreement). (8) to provide you with customer support. (9) to protect you from an unauthorized use of your account and against fraud. (10) for tax, legal and accounting purposes. and (11) for any other purpose with your consent.</p> <p> <strong> <u>Disclosure of Personal Information</u> </strong> </p> <p>We may disclose personal information we collect from you: (1) to our subsidiaries and affiliates, including CD PROJEKT S.A. who helps us providing you with GWENT and enable you to participate in GWENT esports competition. (2) to contractors, service providers, and other third parties we use to operate our systems, deliver services and to assist us with marketing. (3) to other GOG users and the general public (in case of public profiles or through your use of certain features of GOG services). (4) for legal reasons or in the event of a dispute. (5) if we believe disclosure is necessary or appropriate to protect the rights, property or safety of us, GOG users or others. or (6) with your consent.</p> <p> <strong> <u>Your Rights</u> </strong> </p> <p>As a California resident, you have the following rights under the CCPA regarding your personal information:</p> <ul> <li> <strong>Access, update, and correct personal information</strong> <br> You have the right to request access to and receive the following information about personal information we maintain about you in the preceding 12 months.<br> (1) The categories of personal information we collected about you.<br> (2) The categories of sources from which the personal information is collected.<br> (3) The business or commercial purpose for collecting personal information.<br> (4) The categories of third parties to whom we sell or with whom we share your personal information.<br> (5) The specific pieces of personal information we collected about you (i.e. data portability rights).<br> (6) If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: (i) sales, identifying the personal information categories that each category of recipient purchased. and (ii) disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.</li> <li> <strong>We don’t sell your personal information, and therefore are not required to provide an opt-out process.</strong> </li> <li> <strong>Delete Personal Information</strong> <br> You have the right to request that we delete any of your personal information we collected and retained, subject to certain exceptions. Once we receive and verify your user request, we will delete your personal information from our records. However, we may deny your deletion request if retaining the information is necessary for us or our service providers under certain circumstances, which we will explain to you at the time of the denial, if any.</li> </ul> <p> <strong> <u>Contact Us</u> </strong> </p> <p>Whether or not you are currently a GOG user, if you would like to exercise your rights regarding your personal information, or have any questions or comments concerning this Privacy Statement, please contact us via this online form or at privacy@gog.com.</p> <p> <strong> <u>Non-Discrimination</u> </strong> </p> <p>We will not discriminate against you for exercising any of your CCPA rights by offering different pricing or products, or by providing you with a different level or quality of products, or in connection with promotions or other offerings.</p> <p> <strong> <u>Non-Personal Information</u> </strong> </p> <p>This Privacy Statement does not restrict our collection, use or disclosure of any aggregated information or information that does not identify, or cannot be reasonably linked to, any individual, which is defined under the CCPA as not personal information.</p> <p> <strong> <u>Updates</u> </strong> </p> <p>We may change this Privacy Statement if we think it's necessary for legal reasons or to reflect changes in GOG services. If so, we will make the changed Privacy Statement available online and (if you have a GOG account) we'll email you to explain the changes. We will also update the “Last Updated” date.
