Cookie Policy Last updated: October 2016 Introduction 1. <p> The SmartRubric website and associated applications (the <strong>Site</strong>) are owned and operated by Pinemarten Education Limited a company registered in England and Wales with registered number 09605659, registered office at Kemp House, City Road, London EC1V 2NX (<strong>we</strong>, <strong>us</strong>). By using the Site you agree to be bound by this Privacy &amp. Cookie Policy (the <strong>Privacy &amp. Cookie Policy</strong>) and the terms of use accessible on the Site (the <strong>Terms</strong>). This Privacy &amp. Cookie Policy and the Terms affect your legal rights and obligations so please read them carefully. If you do not agree to be bound by this Privacy &amp. Cookie Policy and/or the Terms, do not use the Site. If you have any questions, you can contact us on support@smartrubric.com. </p> 2. <p> We reserve the right to update this Privacy &amp. Cookie Policy from time to time at our discretion. If we do so, the updated version will be effective as soon as it is accessible. If you are a registered user and any changes materially affect your rights or obligations, we shall notify you by email of any such changes. Otherwise, you are responsible for regularly reviewing this Privacy &amp. Cookie Policy so that you are aware of any changes to it. </p> Collecting of Personal Data through the Site 3. <p> If you register with us, you must provide the following information: your name, identity of the educational establishment where you work, and email address. All personal data that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal data. At our request, you shall promptly provide evidence of your identity and proof that you work at the educational establishment you have notified to us. If you provide us with inaccurate or false data, and we suspect or identify fraud, we will record this. You must not register under someone else’s name. </p> 4. <p> If you are a student, and the educational establishment you attend has provided your personal data to us, please contact the educational establishment to obtain a copy of their data protection policy. We ask your educational establishment to obtain your consent so that we may lawfully process your personal data to provide the storage and evaluation services that your educational establishment has purchased from us. If you are a student under this Condition 4, please note that only the provisions of Conditions 4, 5, 9d, 10, 11, 12, 18-27 shall apply to the use of your personal data. In such circumstances, we are the processor of your personal data and the educational establishment is the controller as such terms are defined under applicable laws. </p> 5. <p> When you contact us by email or post, we may keep a record of the correspondence and we may also record any telephone call we have with you. </p> Data we automatically collect 6. <p> When you use the Site, we automatically collect and store information about your device and your activities. This information could include (a) your computer or other device’s unique ID number. (b) your mobile device’s geographic location while you are using the Site. (c) your IP address: (d) technical information about your mobile device such as type of device, web browser or operating system. (e) your preferences and settings such as time zone and language. (f) how long you used the Site and which services and features you used. We collect this information using cookies in accordance with the Cookie section of this Privacy &amp. Cookie Policy and we use the information we collect on an anonymous basis to improve our Site and services, and for analytical and research purposes. </p> 7. <p> We also allow advertisers and advertising networks to collect information about your computer or mobile device, activities, and geographic location to enable them to display targeted ads to you and provide us with anonymous information about our users’ behaviour. Again, this takes place through the use of cookies in accordance with the Cookie section of this Privacy &amp. Cookie Policy. Please note, we do not exercise this right when you are in the section of the Site accessible only by registered users. </p> Use of your Personal Data 8. <p> We may use the personal data of individuals who use the Site to comply with our contractual obligations to you if you are a registered user of the Site including to manage your account and provide the services and support you request. </p> 9. <p> We may also use your personal data for our legitimate interests including to (a) prevent potentially prohibited or illegal activities and enforce the Terms. (b) better understand our users, diagnose and fix problems you may have. (c) for regulatory and legal purposes (for example anti-money laundering). and (d) on an anonymous basis, purposes of recording and analysing the progress and development of teachers, educational establishments and students, for research purposes and for our general business purposes. </p> Who do we share your personal data with? 10. <p> For our legitimate interests, we may share your personal data with any service providers, sub-contractors and agents that we may appoint to perform functions on our behalf and in accordance with our instructions, including payment providers, IT service providers, accountants, auditors and lawyers. We currently use Paypal to process payments and refunds. </p> 11. <p> Under certain circumstances we may have to disclose your personal data under as part of our legal obligations under applicable laws and/or regulations, for example, as part of anti-money laundering processes or protect a third party’s rights, property, or safety. </p> 12. <p> For our legitimate interests, we may also share your personal data in connection with, or during negotiations of, any merger, sale of assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company. </p> Marketing 13. <p> We may also use your personal data for our legitimate interests to send you email or text messages about our services. You can choose to no longer receive emails or text from us by notifying us at info@smartrubric.com. If you do unsubscribe to emails or texts, it may take up to 5 business days for your new preferences to take effect. We shall therefore retain your personal data in our records for marketing purposes until you notify us that you no longer wish to receive emails or texts from us. </p> Cookies &amp. Mobile Device IDs 14. <p> A cookie is a small file that asks permission to be placed on your browser’s memory or alternatively your computer's hard drive. Cookies placed in your browser’s memory are called session cookies and cookies placed on your computer’s hard drive are called persistent cookies. Session cookies are deleted when you close your browser, while persistent cookies remain on your hard drive, even after closing your browser. Session cookies are generally used to improve the user experience when using a website. Persistent cookies are generally used to store user preferences, including the preference to keep a user signed in, between browser sessions. </p> 15. <p> Cookies help us to provide you with a better Site, by enabling us to monitor which pages you find useful and which you do not. All information you provide to us is stored on our secure servers. Any payment transactions are encrypted using SSL technology. Where we have given, or you have chosen a password, you are responsible for keeping this password confidential. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise that your personal information, or other content will always remain secure. </p> 19. <p> We take reasonable steps to ensure the reliability of our personnel who have access to any personal data, and all such personnel have received training in relation to their obligations, and the restrictions that apply, to the lawful processing of personal data. We ensure that only those members of personnel who need to have access to personal data are granted access to such data and only for the purposes of the performance of the Services. </p> 14. <p> We shall permit you or your external advisers (subject to reasonable and appropriate confidentiality undertakings) to inspect and audit our data processing activities and we shall comply with all reasonable requests or directions by you to enable you to verify and procure that we fully comply with our obligations under this Privacy &amp. Cookie Policy or otherwise in relation to our processing of your personal data, please contact us, or you can contact the Information Commissioner, see www.ico.org.uk </p> 24. <p> Our website may contain links to other sites of interest. Once you have used these links to leave our website, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this Privacy &amp. Cookie Policy. </p> 25. <p> We retain your personal data in accordance with applicable laws. Therefore, if you register with us, we shall retain your personal data until you close your account except where we are required to retain your personal data for longer to comply with accounting and taxation requirements. If you receive marketing communications from us, we shall retain your personal data until you opt out of receiving such communications. If you have otherwise contacted us with a question or comment, we shall retain your personal data for 6 months following such contact to respond to any further queries you might have. If your information has been provided to us by an educational establishment, we shall retain your personal data in accordance with the instructions of that educational establishment. </p> General 26. <p> If any provision of this Privacy &amp. Cookie Policy is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect. </p> 27. <p> This Privacy &amp.
