Our privacy policy specifies the data we collect, how we use that data, to who we may disclose that data and your rights. This policy sets out how Vivi collects and uses the information that we collect about you when you use the Vivi services. This policy also explains the choices that you can make about the way that we use your information. Collecting Data When you communicate with us, register as a user, use our product, use our website or submit an enquiry, we collect data. Without this data, we may not be able to effectively provide you with a great experience or enable you to effectively use our product. We may directly collect analytics data to help us measure traffic and usage trends for the Service. These tools collect information sent by your mobile device, including the features you use and other information that assists us in improving the Service. Cookies Vivi uses cookies on its websites to optimise user experience. You can adjust your browser settings to refuse or limit cookies. However, if you do not accept cookies, you may not be able to use parts of our websites. We also use Google Analytics to improve the content and functions of our websites (by collecting information about how visitors use the sites), and the Google AdWords service to provide you with customised advertisements that suit your interests and preferences. Google anonymously collects information such as age, gender, geographical location, webpage views and visits to other websites, including using cookies. You can manage cookie preferences through your Google account, by going to Google Account Settings and editing your preferences. To opt out of being tracked by Google Analytics, you can visit the relevant Google page. Data Usage Vivi defines user data as information, including personal information relating to users of our products and services. Vivi defines customer data as information, including personal information relating to the purchasers of our products and services. Vivi only uses data for the following purposes: <ul> <li>Providing you with the Service: We use the information that you provide us to provide the Service to you. This includes allowing you to log in to Vivi, operating and maintaining the Service. We also use information we collect about you automatically to remember information about you so that you will not have to re-enter it repeatedly.</li> <li>To communicate with you about the Service: We use your contact information to get in touch with you and to send communications about critical elements of the service or information that will improve your experience. For example, we may send you emails about technical issues, security alerts, administrative matters or new, updated or underutilized features.</li> <li>For matters that we are required to use your information by law: We will use or disclose your information where we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement. and (b) to enforce our Terms of Use or to protect the security or integrity of our Service.</li> </ul> Data Security Access by you to your account is available through a password and/or unique username selected by you. This password is encrypted. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal data, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control. (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Website cannot be guaranteed and we shall have no liability to you or any third party for loss, misuse, disclosure or alteration of such information. and (c) any such information and data may be viewed or tampered with in transit by a third party. In the event of a data breach, Vivi is committed to complying in all respects with the requirements of all Privacy Laws in the relevant jurisdiction and where required, the provisions of the GDPR. Please notify us immediately if there is any unauthorised use of your account by any other Internet user, or any other breach of security relating to your account. Data Retention We retain information you provide to us and which we collect about you, including Personal Information and Personal Data, for so long as we continue to provide services to you and specifically until such time as you request us to erase your Personal Information and Personal Data. Access to Personal Information At any time, you may request that Vivi provide you with a copy of the personal data Vivi holds about you in a portable and machine-readable form and/or request that Vivi erases this data from its systems. Disclosing data We may disclose data for the following purposes: <ul> <li>Responding to lawful information requests from courts, government agencies and lawyers;</li> <li>Investigating and dealing with suspected fraud and unlawful activity; Protecting our lawful interests. and</li> <li>In the process of a sale or purchase of us or our business.</li> </ul> Protection of Children's Personal Information Vivi does not store any personal and/or sensitive information of students. Your organization may collect information on its own through the use of Vivi or other Vivi offerings. Collection of information in this way is at your organization’s discretion and is governed by the privacy policies of your organization. Vivi allows for configuration and/or integration options that allow your organization to align the Vivi platform with other organization applications (i.e. authentication/SSO). We do not knowingly collect any Personal Information from individuals under the age of 13 through Vivi offerings, the Vivi app, or the Vivi website. To use the Vivi service you may be identified though your school Google or Microsoft account, which may include your name and email address. Vivi complies with the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA). Under COPPA, we are required to obtain consent to the collection of personal information from children under 13. When schools use Vivi services, the school is required to consent to the collection and use of personal information from students. Any data collected from students is for the use and benefit of students in the educational context, and for no other commercial purpose. Updates We may change our privacy policy from time to time. If we change our privacy policy, we will post the updated privacy policy on our product along with the “Last Updated” date. By continuing to access and use our product after the updated privacy policy has been posted on our product, you agree to our updated privacy policy.
