<u>“We” and “Company”</u> refers to Stormlight Workshop LLC and its subsidiaries.<br>

<u>“Services”</u> refers to games released by Company, related forums, chatrooms, and messages, customer support for such games, and related services such as analytics, billing, and ads.<br>
<br>
<u>“Virtual Currency”</u> refers to in-game currency, including “Gems”.
Such currency has no real world value.<br>
<br>
<u>“In-Game Items” </u>refers to items, Virtual Currency, and accounts created within games released by Company.<br>
<br>
<u>“Skins”</u> refers to layered PSD art files containing the artwork for use in Services and modified versions of such files by Company or the users of Services.
These files are made available so that users can customize their games (including painting their own dragons).<br>

<b>Terms of Use</b>

<br> Company grants you a non-exclusive, non-transferable, revocable limited license, subject to the limitations in these Terms, to access and use the Services for your own non-commercial entertainment purposes, including any ancillary services such as analytics, advertising, and optimization.
You agree to not use the Services for any other purpose.<br>
<br>
<br> By accessing or using Services, you are agreeing to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.
If you do not agree with any of these terms, you are prohibited from using or accessing this site.
The materials contained on Services are protected by applicable copyright and trademark law.<br>

<b>Children</b>

<br> This Service is offered and made available only to users meeting the minimum legal age to provide their own consent to data processing, collection, and use (e.g., at least 13 years of age in the US and at least 13 to 16 years of age in the EU, depending on the country).
If you do not meet the minimum legal age, please discontinue using the Service immediately, or if for any reason, you do not agree with all of the terms contained in this Agreement, please discontinue using the Service immediately.
By using or attempting to use the Service, you certify that you are at least the minimum age and meet any other eligibility requirements of the Service.
If you are found to be under the minimum age, your account may be terminated without notice.<br>

<b>Account</b>

You agree to provide accurate information upon registration.
This includes your own name, your own valid email address, and your own date of birth.
This information must remain accurate, and must be updated if your circumstances change.<br>

It is the user's responsibility to create a strong password and keep that password secure from the knowledge of others.<br>
<br> 3.
Members may not share accounts.
This includes sharing account details with any other member.<br>
<br> 4.
You agree to register a maximum of one account per individual user.<br>
<br> 5.
Your privilege to use the Services is not transferable.
Your account may not be given away or sold to another user or person.<br>
<br> 6.
The sale of In-Game Items from the Services for monetary currency ($USD), cryptocurrency, barter, or other "real-world" currency is prohibited.<br>
<br> 1.
Artists may sell their modified Skins for $USD or "real-world" currency.
Once such Skin is turned into an item on-site, it is considered to be an In-Game Item and may not be sold for $USD or "real-world" currency.<br>
<br> 7.
Company may ban or suspend an account at any time, for any reason, without notification.<br>
<br> 8.
Discussion of, or relating to, specific incidents of account suspension or termination is not permitted on the Services, including forums.
Any and all inquiries regarding an account action should be directed to Contact Us by any affected parties.
This is to protect the account owner.
Please keep in mind that the Company staff, to protect player privacy, will never disclose account-related issues with anyone but the owner of the affected account.<br>

<b>Conduct</b>

You may not use the site for unlawful purposes.
This includes posting, distributing, or promoting content that is illegal.<br>
<br> 2.
You may not post unsolicited advertising in chat or private messages.<br>
<br> 3.
Distributing material which may cause harm to Services or its users is not permitted.
This includes programs designed to damage, disrupt, or allow unauthorized access to user accounts.<br>
<br> 4.
Do not publish your sensitive information or the information of others.<br>
<br> 5.
You may not impersonate another person or imply that you are a Company employee.<br>
<br> 6.
Harassment of other users is not permitted.
This includes abusive language, spamming, or encouraging other users to target an individual by proxy.<br>
<br> 7.
Comments that are abusive, aggressive, personally insulting, or threatening are not permitted.<br>
<br> 8.
Pornography of any kind is not permitted.
This includes written or visual.<br>
<br> 9.
You must agree to and abide by .

Policies for all places where players can input text, including but not limited to: forum messages, clan profiles, dragon profiles, player broadcast messages, dragon names, usernames, and skin submissions.<br>
<br> 10.
Exploitation of glitches or loopholes is not permitted.
The discovery of a new bug should be reported immediately so that Company may take steps to correct the issue.<br>
<br> 11.
The use of bots, scripts, auto-refreshers, or third party software designed to play the game for you in any way is not permitted.<br>
<br> 12.
The use of bots, scripts, or third party software that shortcut or alter site functions to run or appear in ways that are not intended by site design is not permitted.<br>
<br> 13.
The use of bots, scripts, or third party software that generate an excessive amount of concurrent connections or potentially damage site stability is not permitted.
This can fall under the realm of using browser functions, add-ons, extensions, etc.
to hit Company or Services’ server infrastructure in repetitive or disproportionate ways.
These incidents will be reviewed thoroughly on a case-by-case basis.<br>
<br> 14.
In-Game Item "lending" is not a supported transaction.
The Company development and Customer Support team will not be able to assist in cases where a lent In-Game Item is not returned, and these types of deals are conducted at the user's own risk.
To avoid fraudulent trades, please use the Auction House or Crossroads.<br>

<b>Links</b>

<br> Company has not reviewed all of the sites linked to or from its Services and is not responsible for the contents of any such linked site.
The inclusion of any link does not imply endorsement by Company of the site.
Use of any such link is at the user's own risk.
Nothing in this agreement is intended to, or shall be deemed to, establish any joint controller relationship under the General Data Protection Regulation (and similar laws) between Company and its partners, API users, SDKs, and sites or apps that we link to.<br>

<b>Skins Use Policy</b>
<br>

You may display Skins on your personal website provided that you:<br>

Display "© Stormlight Workshop LLC" on or near the image.<br>
<br> 2.
Provide a link or the URL text to or for flightrising.com on or near the image.
<br> 2.
The Skins’ psd template may not be reposted or redistributed.
This is to ensure that anyone downloading our PSD template has the chance to read and understand its terms of use.<br>
<br> 3.
Skins and images derived from our PSD are the property of Company.
You may not use skin or images derived from our PSD template for in print media or for use in another game.<br>
<br> 4.
All sales of Skins from user to user must be negotiated with Company.<br>
<br>
<br>
<b>Art Sales Policy</b>
<br>
<br> 1.
You may sell your digital Services-related fan art or commissions for both "real world" currency or for Virtual Currency.<br>
<br> 1.
Note that Company retains the copyright to its dragons and designs.
<br>
<br> 2.
You may display your fan art on your personal website provided that you provide a link or the URL text to or for flightrising.com on or near the image.<br>
<br> 3.
No more than 5 units be sold of tangible merchandise utilizing the Company’s intellectual property (IP) be sold for "real world" currency.
Making a piece of fan art or a craft project is fine, but making a business out of Company or Services merchandise is not.<br>
<br> 1.
Tangible merchandise utilizing Company or Services IP may be gifted, traded, purchased with Virtual Currency, or raffled (provided the raffle does not utilize "real world" currency) beyond this 5 unit limit, but may not be sold for "real world" currency once the 5 unit limit is exceeded.
<br> 4.
Artwork utilizing the Company or Services IP may not be added to third party, print-service stores.
Example: shapeways, deviantart prints, redbubble, cafepress, zazzle, and similar entities.<br>
<br> 5.
Artwork sales of original works, -tangible and digital- utilizing the artist's own IP may be sold by the artist and have no limitations on units sold.
The limitations above are placed solely on works using Company or Services IP.<br>

<br>
<b>Virtual Currency Purchases</b>

<br> Services includes a feature that allows its players to purchase Virtual Currency.<br>
<br> 1.
All Virtual Currency and In-Game Items sales are final and non-refundable.<br>
<br> 2.
All digital purchases made on Services are for the USE of items within the Services and are not indicative of personal ownership of said items.<br>
<br> 3.
Players who attempt to issue a chargeback on Virtual Currency or In-Game Item purchases will have their account suspended.

<b>Use License</b>

<br> 1.
Permission is granted to temporarily download one copy of the materials (information or software) on Services for personal, non-commercial transitory viewing only.
This is the grant of a license, not a transfer of title, and under this license you may not:<br>

use the materials for any commercial purpose;<br>
<br> 2.
attempt to decompile or reverse engineer any software contained on Services;<br>
<br> 3.
remove any copyright or other proprietary notations from the materials.

transfer the materials to another person or "mirror" the materials on any other server.

The materials on Services are provided "as is". Company makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties.<br>

<b>Limitations</b>

<br> In no event shall Company be liable for any damages arising out of the use or inability to use Services.
Periodic downtime for maintenance and bug fixing should be expected.<br>

Updates to the terms of service may be noted in the news section of the site.
By using our Services you are agreeing to be bound by the then current version of these Terms of Use.
