Playlist Chat Terms of Service
<p>Playlist Chat is a web-based message service provided by WPRK 91.5 Winter Park and Spinitron.
This Terms of Service document applies to all users of Playlist Chat.</p>
Definitions
<p>In the following:</p>
<ul>
<li>“the service” refers to Playlist Chat as mentioned above;</li>
<li>“we” refers to the provider of the service: WPRK 91.5 Winter Park and Spinitron;</li>
<li>“TOS” refers to this document and its terms;</li>
<li>“you” refers to a user of the service;</li>
<li>“chat users” refers to you and/or all current and past users of the service;</li>
<li>“content” refers to chat messages posted by chat users, station staff or third parties.</li>
</ul>
Terms
<p>You use the service subject to the TOS, which we may update at any time without notice.
By accessing and using the service, you accept the TOS and agree to be bound by it.</p>
<p>We are not responsible for any content posted by chat users.
We do not commit to pre-screen or remove content and you agree that we do not have any duty to do so.</p>
<p>No content is confidential.
We may use content in any manner that we choose.
This may include (but is not limited to) publishing it in any from, medium, location or publication and for any purpose, commercial or otherwise.
By using the service you grant us license to use your content in this manner.</p>
<p>You agree to hold us harmless from and against claims arising from your exposure, or the exposure of your family members, loved ones, or computers, to content and agree to waive any possible liability that we may have regarding content that violates any intellectual property rights or any other civil law.</p>
<p>Chat users are solely responsible for the content they post.
We will not be held responsible or liable for any damage incurred from the use of the service or from the publication or use of any content.</p>
<p>We reserve the right to remove any content without notice but we are not obliged to do so except as required by law.
Under no circumstances will we be held responsible for any content that is in breach of copyright or in violation of any other law.</p>
<p>You acknowledge that we may or may not pre-screen and/or remove content but that we shall have the right (but not the obligation) in our sole discretion to pre-screen, refuse, or remove content, including (but not limited to) content that violates the TOS or is otherwise objectionable.</p>
<p>You agree that you must evaluate your use of content and bear all risks associated with its use, including any reliance on its accuracy, completeness, or usefulness.
You acknowledge that you may not rely on any content.</p>
<p>You are solely responsible for the content of your posts, including violation of law, copyright, privacy, and other laws, bylaws, rules and regulations of applicable jurisdictions.
You agree to hold us harmless and defend us and indemnify us from any civil actions filed or threatened to be filed by any third party or entity who determines that your submissions supports a legal cause of action.</p>
Prohibited content
<p>You agree not to post any content that: </p>
<ul>
<li>is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, profane, libelous, invasive of privacy or publicity rights, indecent, misleading, fraudulent, racist, intolerant, hateful, or racially, ethnically or otherwise objectionable.

<li>infringes or violates in any way upon the rights of others;</li>
<li>infringes the privacy others;</li>
<li>under any law, agreement or relationship you do not have the right to make available;</li>
<li>is protected by copyright, trademark or other proprietary rights without the express permission of the rights' owner.
You are responsible for determining whether the material is protected by such rights.
You shall be solely liable for any damages resulting from any infringement of such rights, or any other harm resulting from your content.

<li>violates any applicable laws or regulations;</li>
<li>constitutes unsolicited or unauthorized advertising, promotion, or any other form of solicitation;</li>
<li>solicits other users for any purpose whatsoever;</li>
<li>contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer or communications equipment or software.

<li>impersonates any person or entity, including false impression of your true identity or falsely state or otherwise misrepresent your affiliation with a person or entity.
