Field Researcher Alpha Terms of Service Last updated: 09/05/2023 Effective date: 10/05/2023 Welcome to Field Researcher Alpha, an open-source Discord bot designed to enhance your Discord experience. By using this Discord bot, you agree to the following Terms of Service (“Terms”), so please read them carefully. These Terms govern your use of Field Researcher Alpha, as well as any updates, new features, or additional services that we may provide from time to time. Please note that Field Researcher Alpha is operated by Tickets+ Contributors (“we,” “us,” or “our”), and your use of Field Researcher Alpha is subject to these Terms and our Privacy Policy, which is incorporated into these Terms by reference. Field Researcher Alpha is the official Tickets-Plus repository's public instance. 1. Prohibited Conduct You agree not to use Field Researcher Alpha for any unlawful or prohibited activities, including but not limited to: <ul> <li>Posting or transmitting any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.</li> <li>Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.</li> <li>Using Field Researcher Alpha to transmit any unsolicited or unauthorized advertising, promotional materials, or spam.</li> <li>Attempting to gain unauthorized access to Field Researcher Alpha, its related systems or networks.</li> <li>Interfering with or disrupting Field Researcher Alpha, its related systems or networks, or disobeying any requirements, procedures, policies, or regulations of networks connected to Field Researcher Alpha.</li> <li>Engaging in any activity that could damage, disable, overburden, or impair Field Researcher Alpha or interfere with any other party's use and enjoyment of Field Researcher Alpha.</li> <li>Infringe on any other party's Intellectual Property.</li> </ul> We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. 3. Intellectual Property You acknowledge that Field Researcher Alpha and its related trademarks, logos, and other intellectual property are the exclusive property of Tickets+ Contributors. However, any modifications or additions made to the open-source code of Field Researcher Alpha by users and contributors of the official Tickets-Plus repository are subject to the terms of the applicable open-source license. By submitting modifications or additions to the official Tickets-Plus repository, you grant Tickets+ Contributors a non-exclusive, irrevocable, royalty-free, worldwide license to use, reproduce, distribute, and sublicense any such modifications or additions for any purpose, including without limitation, commercial purposes. You agree not to use or reproduce any of Tickets+ Contributors's intellectual property without prior written consent, except as expressly authorized under the applicable open-source license for modifications or additions made to the open-source code of Field Researcher Alpha by users and contributors of the official Tickets-Plus repository. By submitting tags to the Field Researcher Alpha bot instance you grant its operators a non-exclusive, irrevocable, royalty-free, worldwide license to use, reproduce and distribute the provided tag which consists of a 'key' – shorthand identifier of the tag, 'description' the text value of the tag and, if provided, standard embed parameters. 4. Termination We reserve the right to terminate your use of Field Researcher Alpha at any time and for any reason, without prior notice or liability. This may include termination of your access to certain features or services provided by Field Researcher Alpha. In the event of termination, these Terms will continue to apply, including, without limitation, the provisions regarding ownership and limitations of liability. Additionally, any provisions of these Terms that, by their nature, should survive termination (such as the “Intellectual Property” clause) will survive. If you wish to terminate your use of Field Researcher Alpha, you may do so at any time by removing Field Researcher Alpha from your Discord server. 5. Limitation of Liability You acknowledge and agree that Tickets+ Contributors shall not be liable for any damages arising out of or related to your use of Field Researcher Alpha, including but not limited to direct, indirect, incidental, consequential, special, or exemplary damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses. You further acknowledge and agree that Tickets+ Contributors shall not be liable for any damages resulting from: <ul> <li>The use or inability to use Field Researcher Alpha;</li> <li>Any unauthorized access to or alteration of your transmissions or data;</li> <li>Any bugs, viruses, trojan horses, or the like that may be transmitted to or through Field Researcher Alpha;</li> <li>The deletion of, corruption of, or failure to store any content or other data maintained or transmitted by Field Researcher Alpha;</li> <li>Your failure to provide accurate account information, or</li> <li>Your failure to keep your password or account details secure and confidential.</li> </ul> The limitations of liability set forth in this section shall apply even if Tickets+ Contributors has been advised of the possibility of such damages. You agree that the limitations of liability set forth in this section are fundamental elements of these Terms, and that Tickets+ Contributors would not provide Field Researcher Alpha to you absent such limitations. 6. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of Finland, without giving effect to any principles of conflicts of law. 7. Changes to Terms We reserve the right to update or modify these Terms of Service at any time, without prior notice or liability. Any changes to the Terms of Service will be communicated through a notice on the Tickets-Plus official repository, and it is your responsibility to review the changes. Your continued use of Field Researcher Alpha after any such changes shall constitute your acceptance of the new Terms. Should any change be applied to the Terms of Service, the date of the last update will be displayed at the top of this page. 8.
