Acceptable Use Guidelines Effective Date: August 8, 2014 General Statement The exchange of information is a fundamental and important activity of any society. IronSocket is dedicated to providing technologies and services that allow for the safe exchange of information via the internet and its many resources. Our goal is to help users easily access information available on the internet in a manner that best protects their rights and privacy. The purpose of providing Acceptable Use Guidelines (the "AUG") is to clarify for what purposes our services and network(s) may be used. This AUG is intended to act as a guide and is not intended to be all encompassing. Only individuals with an active subscription plan may access our network(s) and use our services. Our Terms of Use and Privacy Policy, incorporated herein by reference, including the limitations on liability, apply to this AUG. In the event of any conflict, the Terms of Use shall control. Our Network The primary purpose of our network is to facilitate the transfer of information (packets) between user devices and remote servers. Our network is comprised of servers, routers, firewalls, load-balancers, connectivity switches and other hardware and software required to connect to the internet and to deliver our services. Acceptable Use Proper and acceptable use of our network is to utilize it, in general, in any legal manner. We allow all information (content) that does not violate applicable laws. We do not allow our network and services to be used in any manner which violates any applicable law, causes harm to our network , to us or other users, or in any manner that interferes with the use of our services by other users (each a "Misuse"). All users are granted equal access to our network. Any Misuse of the network is a violation of our Terms of Use. DNS Services We supply redundant domain name services for all users with an active subscriber plan to our services. In rare instances, where extreme loads (DNS lookups) utilize disproportionate resources of the redundant DNS systems, we will notify you of potential violation of our Terms of Use. IP Addresses All Internet Protocol (IP) Addresses provided by us and used in the provisioning of our services are licensed and managed by us. IP Addresses provided by the Company are non-transferable, and no user is granted ownership or transfer rights in or to our IP Addresses. All IP Addresses are assigned by our engineering team on a per server basis. Any use or attempted use of IP Addresses on our network which are not specifically authorized by us for use is a violation of our Terms of Use. IRC We allow users to connect to IRC servers through our network. We DO NOT host IRC applications or functionality directly on our network. Peer to Peer. Bit Torrent We allow the use of bit torrent protocols and internet peer-to-peer software for file sharing purposes, but ONLY if you have an active subscription to our services AND ONLY on servers located in specific territories. You are responsible for determining the legal status of any intellectual property you access, use or copy through our network, Site and Services. You agree to not transfer copyrighted works through our network without the express permission of the copyright holder. Whenever you upload or download material to our Site or through our Services, you agree to comply with our content standards, our Acceptable Use Guidelines and our Prohibited Activities as described in the Terms of Use. You agree that you will not infringe any copyright, and that all materials uploaded and downloaded by you comply with these standards and requirements. You hereby indemnify us for any breach of that warranty. Disclaimer We retain the right, at our sole discretion, to refuse service to any individual and to discontinue service without notice and without refund for any violation of our policies and guidelines.
