TermsofUse(Rev.133ED55),1/12,StateofAlabamaRev.133ED55,TERMSOFUSE,SADD:SCALABLEANONYMOUSDISPOSABLE,DESKTOPS,VersionDate:February04,2020,TERMSOFUSEAGREEMENT,ThisTermsofUseAgreement(“Agreement”)constitutesalegallybindingagreementmadebetweenyou,,whetherpersonallyoronbehalfofanentity(“user”or“you”)andJacksonCSConsultingLLCandits,affiliatedcompanies(collectively,“Company”or“we”or“us”or“our”),concerningyouraccesstoanduse,ofthehttps://sadd.iowebsiteaswellasanyothermediaform,mediachannel,mobilewebsiteormobile,applicationrelatedorconnectedthereto(collectively,the“Website”).TheWebsiteprovidesthefollowing,service:RemotelycontrolvirtualmachinesthatareroutedthroughtheTornetworkandforensically,disposedattheendoftheusersession.(“CompanyServices”).Supplementaltermsandconditionsor,documentsthatmaybepostedontheWebsitefromtimetotime,areherebyexpresslyincorporatedinto,thisAgreementbyreference.,CompanymakesnorepresentationthattheWebsiteisappropriateoravailableinotherlocationsother,thanwhereitisoperatedbyCompany.TheinformationprovidedontheWebsiteisnotintendedfor,distributiontoorusebyanypersonorentityinanyjurisdictionorcountrywheresuchdistributionoruse,wouldbecontrarytolaworregulationorwhichwouldsubjectCompanytoanyregistrationrequirement,withinsuchjurisdictionorcountry.Accordingly,thosepersonswhochoosetoaccesstheWebsitefrom,otherlocationsdosoontheirowninitiativeandaresolelyresponsibleforcompliancewithlocallaws,if,andtotheextentlocallawsareapplicable.,Alluserswhoareminorsinthejurisdictioninwhichtheyreside(generallyundertheageof18)musthave,thepermissionof,andbedirectlysupervisedby,theirparentorguardiantousetheWebsite.Ifyouarea,minor,youmusthaveyourparentorguardianreadandagreetothisAgreementpriortoyouusingthe,Website.Personsundertheageof13arenotpermittedtoregisterfortheWebsiteorusetheCompany,Services.,YOUACCEPTANDAGREETOBEBOUNDBYTHISAGREEMENTBYACKNOWLEDGINGSUCH,ACCEPTANCEDURINGTHEREGISTRATIONPROCESS(IFAPPLICABLE)ANDALSOBY,CONTINUINGTOUSETHEWEBSITE.IFYOUDONOTAGREETOABIDEBYTHISAGREEMENT,,ORTOMODIFICATIONSTHATCOMPANYMAYMAKETOTHISAGREEMENTINTHEFUTURE,DO,NOTUSEORACCESSORCONTINUETOUSEORACCESSTHECOMPANYSERVICESORTHE,WEBSITE.,PURCHASES;PAYMENT,TermsofUse(Rev.133ED55),2/12,Companybillsyouthroughanonlinebillingaccountforpurchasesofproductsand/orservices.Youagree,topayCompanyallchargesatthepricesthenineffectfortheproductsyouorotherpersonsusingyour,billingaccountmaypurchase,andyouauthorizeCompanytochargeyourchosenpaymentproviderfor,anysuchpurchases.Youagreetomakepaymentusingthatselectedpaymentmethod.Ifyouhave,orderedaproductorservicethatissubjecttorecurringchargesthenyouconsenttoourchargingyour,paymentmethodonarecurringbasis,withoutrequiringyourpriorapprovalfromyouforeachrecurring,chargeuntilsuchtimeasyoucanceltheapplicableproductorservice.Companyreservestherightto,correctanyerrorsormistakesinpricingthatitmakesevenifithasalreadyrequestedorreceived,payment.SalestaxwillbeaddedtothesalespriceofpurchasesasdeemedrequiredbyCompany.,Companymaychangepricesatanytime.AllpaymentsshallbeinU.S.dollars.,REFUNDPOLICY,Allsalesarefinalandnorefundsshallbeissued.,MOBILEAPPLICATIONLICENSE,UseLicense,IfyouareaccessingtheCompanyServicesviaamobileapplication,thenCompanygrantsyoua,revocable,non-exclusive,non-transferable,limitedrighttoinstallandusetheapplicationonwireless,handsetsownedandcontrolledbyyou,andtoaccessandusetheapplicationonsuchdevicesstrictlyin,accordancewiththetermsandconditionsofthislicense.Youshallusetheapplicationstrictlyin,accordancewiththetermsofthislicenseandshallnot:(a)decompile,reverseengineer,disassemble,,attempttoderivethesourcecodeof,ordecrypttheapplication;(b)makeanymodification,adaptation,,improvement,enhancement,translationorderivativeworkfromtheapplication;(c)violateanyapplicable,laws,rulesorregulationsinconnectionwithyouraccessoruseoftheapplication;(d)remove,alteror,obscureanyproprietarynotice(includinganynoticeofcopyrightortrademark)ofCompanyorits,affiliates,partners,suppliersorthelicensorsoftheapplication;(e)usetheapplicationforanyrevenue,generatingendeavor,commercialenterprise,orotherpurposeforwhichitisnotdesignedorintended;(f),maketheapplicationavailableoveranetworkorotherenvironmentpermittingaccessorusebymultiple,devicesorusersatthesametime;(g)usetheapplicationforcreatingaproduct,serviceorsoftwarethat,is,directlyorindirectly,competitivewithorinanywayasubstitutefortheapplication;(h)usethe,applicationtosendautomatedqueriestoanywebsiteortosendanyunsolicitedcommerciale-mail;or(i),useanyproprietaryinformationorinterfacesofCompanyorotherintellectualpropertyofCompanyinthe,design,development,manufacture,licensingordistributionofanyapplications,accessoriesordevicesfor,usewiththeapplication.,TermsApplicabletoAppleandAndroidDevices,ThefollowingtermsapplywhenyouuseamobileapplicationobtainedfromeithertheAppleStoreor,GooglePlaytoaccesstheCompanyServices.YouacknowledgethatthisAgreementisconcluded,betweenyouandCompanyonly,andnotwithAppleInc.orGoogle,Inc.(eachan“AppDistributor”),and,Company,notanAppDistributor,issolelyresponsiblefortheCompanyapplicationandthecontent,TermsofUse(Rev.133ED55),3/12,thereof.(1)SCOPEOFLICENSE:ThelicensegrantedtoyoufortheCompanyapplicationislimitedtoa,non-transferablelicensetousetheCompanyapplicationonadevicethatutilizestheAppleiOSor,Androidoperatingsystem,asapplicable,andinaccordancewiththeusagerulessetforthinthe,applicableAppDistributortermsofservice.(2)MAINTENANCEANDSUPPORT:Companyissolely,responsibleforprovidinganymaintenanceandsupportserviceswithrespecttotheCompanyapplication,,asspecifiedinthisAgreement,orasrequiredunderapplicablelaw.YouacknowledgethateachApp,Distributorhasnoobligationwhatsoevertofurnishanymaintenanceandsupportserviceswithrespectto,theCompanyapplication.(3)WARRANTY:Companyissolelyresponsibleforanyproductwarranties,,whetherexpressorimpliedbylaw,totheextentnoteffectivelydisclaimed.Intheeventofanyfailureof,theCompanyapplicationtoconformtoanyapplicablewarranty,youmaynotifyanAppDistributor,and,theAppDistributor,inaccordancewithitstermsandpolicies,mayrefundthepurchaseprice,ifany,paid,fortheCompanyapplication,andtothemaximumextentpermittedbyapplicablelaw,anAppDistributor,willhavenootherwarrantyobligationwhatsoeverwithrespecttotheCompanyapplication,andanyother,claims,losses,liabilities,damages,costsorexpensesattributabletoanyfailuretoconformtoany,warrantywillbeCompany’ssoleresponsibility.(4)PRODUCTCLAIMS:YouacknowledgethatCompany,,notanAppDistributor,isresponsibleforaddressinganyclaimsofyoursoranythirdpartyrelatingtothe,Companyapplicationoryourpossessionand/oruseoftheCompanyapplication,including,butnotlimited,to:(i)productliabilityclaims;(ii)anyclaimthattheCompanyapplicationfailstoconformtoanyapplicable,legalorregulatoryrequirement;and(iii)claimsarisingunderconsumerprotectionorsimilarlegislation.(5),INTELLECTUALPROPERTYRIGHTS:Youacknowledgethat,intheeventofanythirdpartyclaimthat,theCompanyapplicationoryourpossessionanduseoftheCompanyapplicationinfringesathirdparty’s,intellectualpropertyrights,theAppDistributorwillnotberesponsiblefortheinvestigation,defense,,settlementanddischargeofanysuchintellectualpropertyinfringementclaim.(6)LEGALCOMPLIANCE:,Yourepresentandwarrantthat(i)youarenotlocatedinacountrythatissubjecttoaU.S.government,embargo,orthathasbeendesignatedbytheU.S.governmentasa“terroristsupporting”country;and(ii),youarenotlistedonanyU.S.governmentlistofprohibitedorrestrictedparties.(7)THIRDPARTY,TERMSOFAGREEMENT:Youmustcomplywithapplicablethirdpartytermsofagreementwhenusing,theCompanyapplication,e.g.,ifyouhaveaVoIPapplication,thenyoumustnotbeinviolationoftheir,wirelessdataserviceagreementwhenusingtheCompanyapplication.(8)THIRDPARTY,BENEFICIARY:CompanyandyouacknowledgeandagreethattheAppDistributors,andtheir,subsidiaries,arethirdpartybeneficiariesofthisAgreement,andthat,uponyouracceptanceoftheterms,andconditionsofthisAgreement,eachAppDistributorwillhavetheright(andwillbedeemedtohave,acceptedtheright)toenforcethisAgreementagainstyouasathirdpartybeneficiarythereof.,SUBMISSIONS,Youacknowledgeandagreethatanyquestions,comments,suggestions,ideas,feedbackorother,informationabouttheWebsiteortheCompanyServices("Submissions")providedbyyoutoCompany,arenon-confidentialandCompany(aswellasanydesigneeofCompany)shallbeentitledtothe,unrestricteduseanddisseminationoftheseSubmissionsforanypurpose,commercialorotherwise,,withoutacknowledgmentorcompensationtoyou.,PROHIBITEDACTIVITIES,TermsofUse(Rev.133ED55),4/12,YoumaynotaccessorusetheWebsiteforanyotherpurposeotherthanthatforwhichCompanymakes,itavailable.TheWebsitemaynotbeusedinconnectionwithanycommercialendeavorsexceptthose,thatarespecificallyendorsedorapprovedbyCompany.Prohibitedactivityincludes,butisnotlimitedto:,A.criminalortortiousactivity,B.attemptingtoimpersonateanotheruserorpersonorusingtheusernameofanotheruser,C.attemptingtobypassanymeasuresoftheWebsitedesignedtopreventorrestrictaccesstothe,Website,oranyportionoftheWebsite,D.deciphering,decompiling,disassemblingorreverseengineeringanyofthesoftwarecomprisingor,inanywaymakingupapartoftheWebsite,E.deletingthecopyrightorotherproprietaryrightsnoticefromanyWebsitecontent,F.engaginginanyautomateduseofthesystem,suchasusinganydatamining,robotsorsimilardata,gatheringandextractiontools,G.harassing,annoying,intimidatingorthreateninganyCompanyemployeesoragentsengagedin,providinganyportionoftheCompanyServicestoyou,H.exceptasmaybetheresultofstandardsearchengineorInternetbrowserusage,usingor,launching,developingordistributinganyautomatedsystem,including,withoutlimitation,anyspider,,robot(or"bot"),cheatutility,scraperorofflinereaderthataccessestheWebsite,orusingorlaunching,anyunauthorizedscriptorothersoftware,I.interferingwith,disrupting,orcreatinganundueburdenontheWebsiteorthenetworksorservices,connectedtotheWebsite,J.makinganyunauthorizeduseoftheCompanyServices,includingcollectingusernamesand/or,emailaddressesofusersbyelectronicorothermeansforthepurposeofsendingunsolicitedemail,or,creatinguseraccountsbyautomatedmeansorunderfalsepretenses,K.sellingorotherwisetransferringyourprofile,L.systematicretrievalofdataorothercontentfromtheWebsiteto gthecontactinformationbelow.,WITHOUTLIMITINGANYOTHERPROVISIONOFTHISAGREEMENT,COMPANYRESERVESTHE,RIGHTTO,INCOMPANY’SSOLEDISCRETIONANDWITHOUTNOTICEORLIABILITY,DENY,ACCESSTOANDUSEOFTHEWEBSITEANDTHECOMPANYSERVICES,TOANYPERSONFOR,ANYREASONORFORNOREASONATALL,INCLUDINGWITHOUTLIMITATIONFORBREACHOF,ANYREPRESENTATION,WARRANTYORCOVENANTCONTAINEDINTHISAGREEMENT,OROF,ANYAPPLICABLELAWORREGULATION,ANDCOMPANYMAYTERMINATEYOURUSEOR,PARTICIPATIONINTHEWEBSITEANDTHECOMPANYSERVICES,DELETEYOURPROFILEAND,ANYCONTENTORINFORMATIONTHATYOUHAVEPOSTEDATANYTIME,WITHOUTWARNING,,INCOMPANY’SSOLEDISCRETION.,InordertoprotecttheintegrityoftheWebsiteandCompanyServices,Companyreservestherightatany,timeinitssolediscretiontoblockcertainIPaddressesfromaccessingtheWebsiteandCompany,Services.,AnyprovisionsofthisAgreementthat,inordertofulfillthepurposesofsuchprovisions,needtosurvive,theterminationorexpirationofthisAgreement,shallbedeemedtosurviveforaslongasnecessaryto,fulfillsuchpurposes.,YOUUNDERSTANDTHATCERTAINSTATESALLOWYOUTOCANCELTHISAGREEMENT,,WITHOUTANYPENALTYOROBLIGATION,ATANYTIMEPRIORTOMIDNIGHTOFCOMPANY’S,THIRDBUSINESSDAYFOLLOWINGTHEDATEOFTHISAGREEMENT,EXCLUDINGSUNDAYS,ANDHOLIDAYS.TOCANCEL,CALLACOMPANYCUSTOMERCAREREPRESENTATIVEDURING,NORMALBUSINESSHOURSUSINGTHECONTACTINFORMATIONLISTINGBELOWINTHIS,AGREEMENTORBYACCESSINGYOURACCOUNTSETTINGS.THISSECTIONAPPLIESONLYTO,INDIVIDUALSRESIDINGINSTATESWITHSUCHLAWS.,TermsofUse(Rev.133ED55),7/12,IfCompanyterminatesorsuspendsyouraccountforanyreason,youareprohibitedfromregisteringand,creatinganewaccountunderyourname,afakeorborrowedname,orthenameofanythirdparty,even,ifyoumaybeactingonbehalfofthethirdparty.Inadditiontoterminatingorsuspendingyouraccount,,Companyreservestherighttotakeappropriatelegalaction,includingwithoutlimitationpursuingcivil,,criminal,andinjunctiveredress.,MODIFICATIONS,ToAgreement,CompanymaymodifythisAgreementfromtimetotime.AnyandallchangestothisAgreementwillbe,postedontheWebsiteandrevisionswillbeindicatedbydate.Youagreetobeboundtoanychangesto,thisAgreementwhenyouusetheCompanyServicesafteranysuchmodificationbecomeseffective.,Companymayalso,initsdiscretion,choosetoalertalluserswithwhomitmaintainsemailinformationof,suchmodificationsbymeansofanemailtotheirmostrecentlyprovidedemailaddress.Itistherefore,importantthatyouregularlyreviewthisAgreementandkeepyourcontactinformationcurrentinyour,accountsettingstoensureyouareinformedofchanges.Youagreethatyouwillperiodicallycheckthe,WebsiteforupdatestothisAgreementandyouwillreadthemessageswesendyoutoinformyouofany,changes.ModificationstothisAgreementshallbeeffectiveafterposting.,ToServices,Companyreservestherightatanytimetomodifyordiscontinue,temporarilyorpermanently,the,CompanyServices(oranypartthereof)withorwithoutnotice.YouagreethatCompanyshallnotbe,liabletoyouortoanythirdpartyforanymodification,suspensionordiscontinuanceoftheCompany,Services.,DISPUTES,BetweenUsers,IfthereisadisputebetweenusersoftheWebsite,orbetweenusersandanythirdparty,youunderstand,andagreethatCompanyisundernoobligationtobecomeinvolved.Intheeventthatyouhaveadispute,withoneormoreotherusers,youherebyreleaseCompany,itsofficers,employees,agentsand,successorsinrightsfromclaims,demandsanddamages(actualandconsequential)ofeverykindor,nature,knownorunknown,suspectedandunsuspected,disclosedandundisclosed,arisingoutoforin,anywayrelatedtosuchdisputesand/ortheCompanyServices.,WithCompany,A.GoverningLaw;Jurisdiction.ThisAgreementandallaspectsoftheWebsiteandCompany,ServicesshallbegovernedbyandconstruedinaccordancewiththeinternallawsoftheStateof,Alabama,withoutregardtoconflictoflawprovisions.Withrespecttoanydisputesorclaimsnot,subjecttoinformaldisputeresolutionorarbitration(assetforthbelow),youagreenottocommenceor,TermsofUse(Rev.133ED55),8/12,prosecuteanyactioninconnectiontherewithotherthaninthestateandfederalcourtslocatedin,LowndesCountyCounty,StateofAlabama,andyouherebyconsentto,andwaivealldefensesof,lackofpersonaljurisdictionandforumnonconvenienswithrespectto,venueandjurisdictioninsuch,stateandfederalcourts.ApplicationoftheUnitedNationsConventiononContractsforthe,InternationalSaleofGoodsisexcludedfromthisAgreement.Additionally,applicationoftheUniform,ComputerInformationTransactionAct(UCITA)isexcludedfromthisAgreement.Innoeventshallany,claim,actionorproceedingbyyourelatedinanywaytotheWebsiteorCompanyServicesbe,institutedmorethantwo(2)yearsafterthecauseofactionarose.,B.InformalResolution.Toexpediteresolutionandcontrolthecostofanydispute,controversyor,claimrelatedtothisAgreement("Dispute"),youandCompanyagreetofirstattempttonegotiateany,Dispute(exceptthoseDisputesexpresslyprovidedbelow)informallyforatleastthirty(30)daysbefore,initiatinganyarbitrationorcourtproceeding.Suchinformalnegotiationscommenceuponwritten,noticefromonepersontotheother.,C.BindingArbitration.IfyouandCompanyareunabletoresolveaDisputethroughinformal,negotiations,eitheryouorCompanymayelecttohavetheDispute(exceptthoseDisputesexpressly,excludedbelow)finallyandexclusivelyresolvedbybindingarbitration.Anyelectiontoarbitratebyone,partyshallb
