C .ShowHeroes G roup,toanyoftheiremployees,workers,staffmembers,,11.4.InnoeventshallShowHeroesberesponsibleforthecreationor,maintenanceoftheServices,foranylossofprofitstopartnersorthird12.LiabilityofShowHeroes,parties,thatarecausedbytheuseorbytheinabilitytousetheServices.12.1.Incaseofslightorordinarynegligence,ShowHeroesshallonlybeliablein,Theexclusionofliabilityprovidedhereinwillnotbevalidintheeventofcaseofaviolationofsignificantcontractualobligationsortheviolationof,maliciousintentorgrossnegligencebyShowHeroes.aguarantee.Significantcontractualobligationsareobligationsthatenable,11.5.ShowHeroesmakesnoguaranteetotheaccuracy,truthfulness,andwhichPartnercanrely.Theliabilitytopaydamagesincaseofinfringement,completenessoftheAdvertisingMessagesbyAdvertisersandhasnoofsignificantcontractualobligationsshallbelimitedasfollows:(i),controloverthem,thereforeitisintendedthattheAdvertiserwillbetheShowHeroes’liabilityshallbelimitedtoforeseeabledamageineachcase,,onlyoneresponsibleforthecontentsoftheAdvertisingMessage.(ii)ShowHeroesshallnotbeliableforlostprofitsorindirector,11.6.Furthermore,ShowHeroesdoesnotofferanyguaranteeconcerning:theamountwhichwasactuallypaidouttoitduringthe12months,(a)theidentity,legalcapacity,seriousnessofintent,orotherprecedingthedamageevent.,characteristicsofAdvertisers;thequality,lawfulnessandsafetyof,theproductsand/orservicesintheAdvertisingMessages;the12.2.Totheextentanydisclaimerorlimitationofliabilitydoesnotapply,all,truthfulnessandaccuracyofthedescriptionsprovided.applicableexpress,implied,andstatutorywarrantieswillbelimitedin,(b)resultsobtainedthroughtheuseoftheServices,inparticular:durationtoaperiodofthirty(30)daysafterthedateonwhichPartner,11.b.1.regardingthelevelofImpressionsorclicksorviewsfirstusedthePlatform,andnowarrantiesshallapplyaftersuchperiod.,thatwillbegeneratedbytheAdvertisingMessages;,11.b.2.thelevelofmonetizationoftheVideo C ontent;12.3.Theaboveregulationsdonotconstituteamodificationoftheburdenof,11.b.3.andthequalityofmatchingVideo C ontentand/orprooftothedetrimentofPartner.,AdvertisingMessagestoDigitalMediacontentusing,Showheroes’SemanticTechnology.13.DeclarationsandWarranties,expressorimplied,including,butnotlimitedtotheimpliedwarrantiesof,anycontentavailableontheShowHeroesServicecomplieswiththis,representatives,andvicariousagents.,theproperfulfilmentofthecontractandthoseuponthefulfilmentof,consequentialdamage,(iii)ShowHeroes’totalliabilityshallbelimitedto,Feb.2nd2021TERMS&.
